FAIR EMPLOYMENT TRIBUNAL
CASE REF: 00115/00FET
CLAIMANT: Claire Nellis
RESPONDENT: South & East Belfast HSS Trust
DECISION ON AN APPLICATION FOR REVIEW
The application by the claimant for an extension of time in which to apply for a review of the Tribunal's decision to dismiss her claim is granted. The decision of 29 August 2006 to dismiss the claim is revoked.
Constitution of Tribunal:
Chairman: Mrs Watson
Members: Mrs Adams
Mr Barbour
Appearances:
The claimant was represented by Mr Philip Boomer of NIPSA.
The respondent was represented by Mr A Devlin, Barrister-at-Law, instructed by MSC Daly, Solicitors.
- The decision to dismiss this claim was given orally at the hearing on 29 August 2006 and sent to the parties on 13 September 2006.
- The claimant's representative wrote to the Tribunal on 1 December 2006 to request that the decision be reviewed on the grounds that it was just and equitable to do so. An application was also made for an extension of time in which to lodge the review application.
- The Tribunal considered the application for review under Rule 30(3)(e) of the Fair Employment Tribunal (Rules of Procedure) Regulations (Northern Ireland) 2005 and formed the view that there were exceptional circumstances in this matter which warranted the revocation of the original decision. The case will be re-listed for hearing by a new panel.
