DECISION
The unanimous decision of the Tribunal is that the application is dismissed.
Appearances:
The applicant did not appear nor was she represented.
The respondent was debarred from defending the proceedings by a decision of the Fair Employment Tribunal dated 20 December 2000 and the Notice of Appearance was struck out.
- The Office of Tribunals had written to the applicant by letters dated 24 May 2002, 17 June 2002, 11 July 2002, 22 August 2002 and 27 September 2002 asking her to confirm whether she wished to proceed to hearing since the respondent is bankrupt. No reply was received from the applicant.
- The applicant did not appear, nor was she represented.
- The Tribunal considered the provisions of Rule 8(3) of the Fair Employment Tribunal (Rules of Procedure) Regulations (Northern Ireland) 1989 as amended. The Tribunal decided to dismiss the application in the absence of any evidence on oath as to the circumstances of the applicant's complaint.
