DECISION
The unanimous decision of the tribunal is that Mr Robinson's claim is dismissed, having been withdrawn by him, and Mr Stitt's claim is dismissed after consideration of his Originating Application and the Notice of Appearance.
Appearances:
Mr Stitt did not appear and was not represented.
Mr Robinson did not appear and his representative did not appear.
The respondent was represented by Mr D McAughey, instructed by Legal Services Department of Belfast City Council
- Mr Stitt was not represented, nor did he appear at the hearing. The tribunal considered the Originating Application, and the Notice of Appearance. In the absence of evidence concerning the nature or extent of his experience in comparison to the successful candidates, the tribunal decided to dismiss his application.
- Mr Robinson's legal representative faxed a letter to the Office of Tribunals confirming that he remained on record for the applicant. He stated that he had no instructions from the applicant and suggested that the application should be treated as withdrawn.
- In these circumstances, Mr Robinson's application is dismissed, having been withdrawn by him.
