Appeal against bail conditions imposed by the Magistrate's Court

JUDGMENT
THE commissioner:
1. The Court is placed in a difficult position in the sense that there is no transcript of the proceedings before the Magistrate's Court. Having said that, however, it is fairly clear from counsel's submissions what the reason for the Magistrate's decision was; the applicant had been found guilty of the serious offence of attempting to pervert the course of justice. Pending sentence, the Magistrate had granted bail on stringent conditions, including the condition that he should not leave the Island, and was then faced immediately with an application for a variation of that condition.
2. We cannot find, having regard to the applicant's record and having regard to the conviction for a very serious offence, that the decision of the Magistrate was so unreasonable that we should set it aside.
3. The application is accordingly refused.
