The Attorney General
-v-
Laurence Munks
Application for bail before the Inferior Number of the Royal Court.
J. C. Gollop, Crown Advocate.
Advocate M. J. Haines for Munks.
JUDGMENT
THE BAILIFF:
1. The Applicant, Laurence Munks, has pleaded guilty to a serious offence of illegally entering the General Hospital and being party to the theft of a quantity of pharmaceutical drugs. The offence was pre-meditated and the Applicant and his co-accused went to the scene with implements, prepared to break into the drugs cupboard in question.
2. The Applicant has been on remand for nearly 9 months and sentence is due to be passed on the 22nd September. He now applies for bail on compassionate grounds, seeking to be released for a period of 1 week following the birth of his child. The Court does sometimes grant bail on compassionate grounds, particularly where it is wished to attend a family funeral, or other circumstances exist where it is fair and right that a prisoner should be released for a limited period.
3. In our judgment this is not an appropriate case for the exercise of compassion. We agree with the Crown Advocate that actions have consequences and the applicant, quite deliberately, committed a serious criminal offence for which he is shortly to be sentenced. It is unfortunate for his girlfriend and perhaps for his girlfriend's family that he will not be there at a crucial stage of her life, but that, we fear, is the consequence of what the Applicant has done.
4. The application is therefore refused.
