ROYAL COURT
(Samedi Division)
23rd May 2003
Before:
|
Sir Philip Bailhache, Bailiff, and Jurats Le
Ruez and Quérée .
|
The Attorney General
-v-
Kevin William Dines
1 count of:
|
Being disorderly on licensed premises,
contrary to Article 83 of the Licensing (Jersey)
Law 1974.
|
Age: 31.
Plea: Guilty
Details of Offence:
During the afternoon and evening of the 18th May, 2002,
Dines had been drinking with his girlfriend. While at the Tipsy Toad, the band at the
pub played the theme tune from the film "The Full Monty". The Defendant, who by his own admission
had now become intoxicated, removed all his clothes during the course of the
song and ended up dancing naked on the stage with the band in front of the
customers.
Details of Mitigation:
Guilty plea at first opportunity;
but for the charge of Grave and Criminal Assault, this matter would have been
dealt with in the Magistrate's Court; fully accepted responsibility; in
full time employment in UK;
return journey to Jersey was particularly
arduous due to inclement weather.
Previous Convictions:
Malicious damage; carrying a
blade in a public place; two drink driving offences; being drunk and
disorderly.
Conclusions:
£250.00 fine or 1
week's imprisonment in default of payment.
Sentence and Observations of Court:
Conclusions granted.
C.M.M. Yates, Esq., Crown Advocate.
Advocate M. St. J. O'Connell for the Defendant.
JUDGMENT
THE BAILIFF:
1.
The
submission was made by your Counsel that we might bind you over for this
offence, but we think that we cannot accept that invitation because you behaved
not only foolishly, but also offensively, on that evening. We cannot be seen to condone the
behaviour which you indulged in on that particular occasion, no doubt as a
result of the drink that you had consumed.
2.
We must,
therefore, fine you; we think that the conclusions of the Crown Advocate are
reasonable, and you are accordingly fined £250.00, or in default one month's
imprisonment, with one week to pay the fine.
