Sentencing by the Inferior Number of the Royal Court, to which the accused was remand by the Criminal Assize on 13th December, 1999, following conviction on:
1 count of: receiving stolen property
[On 13th December, 1999, the accused was acquitted by the assize jury on 3 other counts of receiving stolen property]
Age: 51.
Plea: Not Guilty.
Details of Offence:
Terry pleaded not guilty to four counts of receiving, hiding, and withholding property knowing or believing it to have been stolen. He was acquitted by the jury on three of those counts but convicted on one count which concerned a Sanyo Digital Camera valued at £465.00 which Terry had purchased for £20.00 from a young man whom Terry knew by sight, who had called at the garage where Terry was employed as a forecourt attendant stating that he was selling the camera on behalf of a friend. This same young man had sold another camera to Terry the week before stating that he was selling the camera because he was desperate for cash.
Details of Mitigation:
No available mitigation for a guilty plea, but co-operated fully with the Police in identifying the young man who had sold Sanyo digital camera to him ( and other young men who had sold stolen property to him which was the subject of the three counts on which he was acquitted). Gave full answers and explanations during the course of his question and answer interviews. His co-operation with the police caused him to be placed at some risk ( and Terry was punched on the side of the head by an associate of the young men whilst standing in the Royal Square after the young men and Terry had been indicted before the Royal Court earlier that morning). Treated as a first offender. SER stated that it was unlikely that Terry would appear before a court again.
Previous Convictions: Conviction for handling stolen goods (x2) in Wakefield Crown Court in 1977 for which he received a suspended sentence and total fine of £500. Treated as first offender.
Conclusions: £1,000 fine or 2 months imprisonment in default of payment.
Sentence & Observations of Court: Conclusions (not opposed by defence counsel) granted. Pay £200 forthwith and balance at £50 per week.
