Breach of a 2 years' Probation; 240 hours' community service, made by the Royal Court on 24th September, 1999 (See Jersey Unreported Judgment of that date), following a guilty plea to:
1 count of grave and criminal assault.
Age: 23.
Plea: Breach admitted.
Conclusions:
Probation Order to continue, with balance of community service Order to be completed by September, 2001.
Sentence & Observations of Court: Conclusions granted.
C.E. Whelan, Esq., Crown Advocate;
The accused on his own behalf.
JUDGMENT
THE BAILIFF:
1. I hope it will be obvious to you, from the time which the Court has taken to consider what has been said to us by the Crown Advocate, that we have been troubled as to whether we should in fact go along with what the Crown Advocate is suggesting. The reason for that is that on the last occasion when you appeared before the Court you were told very clearly that if you did not comply with the Order then it was very likely that you would be sent to prison.
2. The Court is not going to do that; we are satisfied that you have been trying to get over your addiction and that it is principally medical reasons that have prevented you from complying with the requirement to carry out the community service.
3. We are going to extend the Order and we are going to give you another year in which to complete the outstanding hours. However, we have to tell you that we expect you to try even harder, if that is possible, than you have been trying so far to conquer your addiction and to comply with your obligation to the Court. The Court grants the conclusions of the Crown Advocate and the time condition will be extended so that you must complete the community service by the end of the Probation Order.
