Application for bail
On 14 November 1997,the applicant pleaded not guilty to 5 counts of fraud (counts 1-5 of first indictment) and guilty to 1 count of the peace (count 1 of second indictment) and was remanded on bail in the sum of £5,000, with conditions of (1) reporting to the Ealing Police three times a week; (2) surrendering his passport; and (3) notifying the Police of any change of address, to stand trial at a Criminal Assize to begin on 9th March, 1998.
On 27 February 1997,the applicant was allowed to change his plea on the first indictment, as follows: count 1: not guilty; count 2: guilty; count 3: not guilty; count 4: guilty; count 5: not guilty, which pleas the Crown accepted, and re applied for bail, on Crown application for remand in custody to 13 March 1998, for preparation of social enquiry report.

JUDGMENT
THE DEPUTY BAILIFF: Before giving this short judgment we have had a look at the two cases that were ‘faxed’ to us this morning by Mr Journeaux, AG-v- Appleyard (28 November 1997)[1997.219] Jersey Unreported and AG -v- Perkins (4 December 1997)[1997.215] Jersey Unreported. Whilst they are not precisely in point they are helpful. Advocate Journeaux has pointed out that the applicant has a fixed address in Middlesex. He is known to the probation authorities there. They have already prepared a probation report for him and he is in work at the moment and supporting two children aged 8 and 12 in Jersey and hoping to make reparation in some way for the money of which he has pleaded guilty to having defrauded people.
He has been on bail for twenty months and has come back to Jersey on five or six occasions to answer to that bail. I think, Mr Journeaux, we can set bail again in the circumstances. The bail terms are renewed: £5,000, reporting three days a week to the police in Middlesex at their convenience. He will, of course, have to give them his address and any change of address must be immediately notified. He should forfeit his passport if he has not already done so, if he has one, and because the Probation Service in Middlesex is going to prepare a report we will remand him, as I understand it, to 3 April. Wells, you are remanded on the same terms to 3 April at 10 o’clock to appear before this Court.
