ROYAL COURT
(Samedi Division)
18 September 1998
Before: F C Hamon, Esq., Deputy Bailiff, and
Jurats Potter and Rumfitt
AG
-v-
Nigel Hall
1 count of contravening Article 8(1) of the Island Planning (Jersey) Law, 1964, by causing or permitting the construction of two wooden sheds and a storage for granite and building materials without the permission of the Planning & Environment Committee, as required by Article 5(1) of the said Law (count 1).
Plea: Facts admitted
Details of Offence:
Defendant erected two wooden sheds in an agricultural field adjacent to but outside his garden.
Details of Mitigation:
Defendant asserted that there had been a misunderstanding between himself and his architect as to whether planning consent was necessary or had been obtained for these sheds.
Previous Convictions: None.
Conclusions: £500 fine with £250 costs.
Sentence and Observations of the Court: Conclusions granted.
The Attorney General
Advocate P de C Mourant for the Defendant
JUDGMENT
THE DEPUTY BAILIFF: We might have taken a more serious view of this matter had not Advocate Mourant - on his clients behalf - made such a full and wholesome apology. The offending sheds and other building materials have now been removed and we have no doubt that a lesson has been learned. We are, therefore, going to fine Mr. Hall £500 with £250 costs and we grant him a week in which to pay.
