Graham v Att. Gen. 2013 (1) JLR 91 (22 January 2013)
Courts-Royal Court-appeals from Magistrate's Court-under Magistrate's Court (Miscellaneous Provisions) (Jersey) Law 1949, Royal Court has wide discretion on appeal-will interfere with decision if sufficiently serious procedural defect or material error of law-if appeal on evidence, will not lightly interfere if evidence on which Magistrate could properly have made decision-will occasionally interfere if simply uncomfortable/uneasy with proceedings below-if Royal Court had serious misgivings about fairness of conviction when appellant unrepresented and lesser offence arguably committed, conviction for lesser offence substituted and sentence reduced
