Gecamines v FG Hemisphere 2012 (2) JLR 172 (17 July 2012)
Administrative Law-organ of state-test-state-owned entity is separate from state (for purposes of immunity and substantive liability and enforcement) if distinct from executive organs of state and has separate legal personality (i.e. may sue or be sued), even if exercises sovereign authority (entitled to immunity in that respect)-separate corporate status respected unless entity in fact has no separate existence-large mining company with separate commercial assets and business is separate entity (and not liable for government's debts), as government control and occasional use of assets as state revenue insufficient to displace presumption of respect for separate corporate status
