Att. Gen. v Bhojwani 2010 JLR 24 (06 November 2008)
Criminal Procedure-proceeds of criminal conduct-money laundering-in prosecution under Proceeds of Crime (Jersey) Law 1999, art. 34(1)(b), prosecution to prove (a) to criminal standard, defendant guilty of "criminal conduct" as defined in art. 1(1); (b) property is or represents proceeds of that conduct; and (c) converted, transferred or removed "for purpose of," i.e. with subjective intention of, avoiding apprehended risk of prosecution for Schedule 1 offence (i.e. serious Jersey offence) or confiscation order-unnecessary to prove commission of Schedule 1 offence-"criminal conduct" and Schedule 1 offence for which avoiding prosecution may be different (e.g. if criminal conduct overseas)
