I, Charlie McConalogue, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 , for the purpose of giving further effect to Commission Regulation (EU) 2021/382 of 3 March 2021¹ , hereby make the following regulations:

1. These Regulations may be cited as the European Union (Food and Feed Hygiene) (Amendment) Regulations 2022.

2. The European Union (Food and Feed Hygiene) Regulations 2020 ( S.I. No. 22 of 2020 ) are amended in Regulation 3, by substituting for the definition of “Regulation No 852/2004” the following-

“‘Regulation No 852/2004’ means Regulation (EC) No 852/2004 of the European Parliament and of the Council of 29 April 2004² as amended by Commission Regulation (EC) No 1019/2008 of 17 October 2008³ , Regulation (EC) No 219/2009 of the European Parliament and of the Council of 11 March 2009⁴ and Commission Regulation (EU) 2021/382 of 3 March 2021;”.

EXPLANATORY NOTE

These Regulations amend European Union (Food and Feed Hygiene) Regulations 2020 ( S.I. No. 22 of 2020 ) to give effect to give effect to Commission Regulation (EU) 2021/382 of 3 March 2021 insofar as it amends Annex II to Regulation (EC) No. 852/2004 of the European Parliament and of the Council on the hygiene of foodstuffs as regards food allergen management, redistribution of food and food safety culture.

These Regulations may be cited as the European Communities (Hygiene of Foodstuffs) (Amendment) Regulations 2022.
