Notice of the making of this Statutory Instrument was published in

I, CHARLIE MCCONALOGUE, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Implementing Directive (EU) 2021/2171 of 7 December 2021¹ , hereby make the following regulations:

1. These Regulations may be cited as the European Union (Cereal Seed) (Amendment) Regulations 2022.

2. The European Union (Cereal Seed) Regulations 2013 ( S.I. No. 217 of 2013 ) are amended in Regulation 2(1) by substituting for the definition of “Directive” (as amended by the European Union (Cereal Seed) (Amendment) Regulations 2021 ( S.I. No. 316 of 2021 )) the following:

3. The European Union (Cereal Seed) (Amendment) Regulations 2021 ( S.I. No. 316 of 2021 ) are revoked.

EXPLANATORY NOTE

(This note is not part of the instrument and does not purport to be a legal interpretation)

These Regulations give effect to the provisions of Commission Implementing Directive (EU) 2021/2171 which corrects an error made in Commission Implementing Directive (EU) 2021/415. This correction restores the species avena nuda to the schedule of species contained in Annex III of Directive 66/402/EEC on the marketing of Cereal Seed.
