I, EAMON RYAN, Minister for Transport, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving effect to Regulation (EC) No. 1008/2008 of the European Parliament and of the Council of 24 September 2008, hereby make the following regulations¹ :

1 These Regulations may be cited as the European Communities (Common Rules for the Operation of Air Services in the Community) (Amendment) Regulations 2021.

2. The European Communities (Common Rules for the Operation of Air Services in the Community) Regulations 2008 ( S.I.No.426 of 2008 ) are amended –

(a) in Regulation 6 –

(i) in paragraph (1), by the substitution of “Commission” for “Minister”,

(ii) in paragraph (2), by the substitution of “Commission” for “Minister”,

(b) in Regulation 7, by the substitution of “Commission” for “Minister”.

EXPLANATORY NOTE

These Regulations amend the European Communities (Common Rules for the Operation of Air Services in the Community) Regulations 2008 ( SI No. 426 of 2008 ). The purpose of these Regulations is to give further effect to the implementation of Regulation (EC) No. 1008/2008 on common rules for the operation of air services in the Community, in so far as to transfer the power to enforce Article 23 of Regulation (EC) No. 1008/2008 from the Minister for Transport to the Commission for Aviation Regulation.
