I, DENIS NAUGHTEN, Minister for Communications, Climate Action and Environment, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), and for the purposes of giving effect to Directive (EU) 2015/1513 of the European Parliament and of the Council of 9 September 20151 , hereby make the following regulations: | ||
1. (1) These Regulations may be cited as the European Union (Renewable Energy) (Amendment) Regulations 2016. | ||
(2) These Regulations come into operation on 1 January 2017. | ||
2. The European Union (Renewable Energy) Regulations 2014 ( S.I. No. 483 of 2014 ) are amended— | ||
(a) by substituting for the definition of “Directive” the following: | ||
“ ‘Directive’ means Directive 2009/28/EC of the European Parliament and of the Council of 23 April 20092 , as amended by Article 2(5) of Directive (EU) 2015/1513 of the European Parliament and of the Council of 9 September 20151;”, | ||
(b) by substituting for paragraph 1 of Schedule 3 the following: | ||
“1. The greenhouse gas emission saving from the use of biofuels and bioliquids shall be: | ||
(a) in the case of installations starting operation after 5 October 2015, at least 60 per cent; | ||
(b) in the case of installations that were in operation on or before 5 October 2015, at least 35 per cent until 31 December 2017 and at least 50 per cent from 1 January 2018.”, and | ||
(c) in Regulation 17(2), by substituting “paragraph (1)” for “paragraph (1)(a)”. | ||
