The Private Security Authority, in exercise of the powers conferred on it by section 51 (as amended by section 15 of the Civil Law (Miscellaneous Provisions) Act 2011 (No.23 of 2011)) of the Private Security Services Act 2004 (No.12 of 2004), with the consent of the Minister for Justice and Equality, hereby makes the following regulations: |

1. These Regulations may be cited as the Private Security (Refund of Fees) Regulations 2015. |
||
2. These Regulations come into operation on 1 March 2015. |
||
3. In these Regulations- |
||
“licence” means a licence of a category standing prescribed for the time being by regulations made under section 51 of the Private Security Services Act 2004 ; |
||
“turnover fee” means the fee calculated by reference to the applicants turnover standing prescribed for the time being by regulations made under section 51 of the Private Security Services Act 2004 . |
||
4. (1) Where the holder of a valid licence ceases to provide a security service and the licence is returned to the Authority, a refund of the turnover fee shall be payable at the appropriate percentage of the turnover fee. |
||
(2) In this Regulation the ‘appropriate percentage’ means the percentage specified in column (3) of Schedule 1 opposite the reference number which relates to the expired period of the licence specified in column (2) at the time the licence is received by the Authority. |

These Regulations provide for a refund of the turnover fee, payable at the appropriate percentage of the turnover fee, in the event that the holder of a valid licence ceases to provide a security service and the licence is returned to the Authority. |
