I, SIMON COVENEY, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Implementing Directive 2012/37/EU of 22 November 2012¹ , hereby make the following regulations—

1. These Regulations may be cited as the European Communities (Seed of Fodder Plants) (Amendment) Regulations 2013.

2. The European Communities (Seed of Fodder Plants) Regulations, 2002 ( S.I. No. 198 of 2002 ) are amended—

(a) in Regulation 2(1) by substituting the definition of—

(i)“authorised officer” the following—

“’authorised officer’ means a person appointed under Regulation 14 of the European Communities (Seed Potatoes) Regulations 2011 ( S.I. No. 532 of 2011 );”, and

(ii)“EC Directive” (as amended by the European Communities (Seed of Fodder Plants) (Amendment) Regulations 2005 ( S.I. No. 918 of 2005 ) the following:

(b) by revoking Regulation 2(2).

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

These Regulations give effect to the provisions of Commission Implementing Directive 2012/37/EU of 22 November 2012 which replaces Annex II concerning Galega orientalis Lam and Annex III replacing Poaceae (Gramineae) of Council Directive 66/401/EEC as regards the marketing of fodder plant seed.
