I, PHIL HOGAN, Minister for the Environment, Community and Local Government, in exercise of the powers conferred on me by sections 7 , 18 (3) and 73 of the Waste Management Act 1996 (No. 10 of 1996), hereby make the following regulations: |

Citation |
||
1. These Regulations may be cited as the Waste Management (Landfill Levy) (Amendment) Regulations 2012. |
||
Commencement |
||
2. These Regulations shall come into operation on 1 July 2012. |
||
Interpretation |
||
3. In these Regulations, save where the context otherwise requires- |
||
"Regulations of 2011" means the Waste Management (Landfill Levy) Regulations 2011 ( S.I. No. 434 of 2011 ). |
||
Amendment of Regulation 3 of Regulations of 2011 |
||
4. Regulation 3(3) of the Regulations of 2011 is amended by deleting- |
||
""end-of-life vehicle" has the meaning assigned to it by article 4(3) of the Waste Management (End-of-Life Vehicles) Regulations 2006 ( S.I. No. 282 of 2006 );" |

Amendment of Regulation 4 of Regulations of 2011 |
||
5. (1) Regulation 4(2)(a) of the Regulations of 2011 is amended by the substitution of "€65" for "€50". |
||
(2) Regulation 4(2)(b) of the Regulations of 2011 is amended by the substitution of "€65" for "€50". |

Amendment of Regulation 6 of Regulations of 2011 |
||
6. Regulation 6(1) of the Regulations of 2011 is amended by deleting subparagraph (h). |

EXPLANATORY NOTE |
||
(This note is not part of the Instrument and does not purport to be a legal interpretation). |
||
These Regulations increase the landfill levy for waste disposed of at authorised and unauthorised landfill facilities from €50 per tonne to €65 per tonne with effect from 1 July 2012. |
||
The Regulations also remove the exemption from the levy for non-metallic residues arising from the shredding of end-of-life vehicles, white goods and other metal waste. |
