I, RICHARD BRUTON, Minister for Jobs, Enterprise and Innovation, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving effect to Directive 2011/17/EU of the European Parliament and of the Council of 9 March 20111 , hereby make the following regulations: |

1. These Regulations may be cited as the European Communities (Calibration of Tanks of Vessels) Regulations 1976 (Revocation) Regulations 2011. |
||
2. With effect from 1 July 2011, the European Communities (Calibration of Tanks of Vessels) Regulations 1976 ( S.I. No. 110 of 1976 ) are revoked. |
||
3. Nothing in these Regulations shall prohibit the use of a vessel the tank of which is marked with a sealing mark according to the provisions of Directive 71/349/EEC of 12 October 19712 on or before 30 June 2011. |
||
4. Nothing in these Regulations shall prohibit the use of a vessel the tank of which has been granted a calibration certificate according to the provisions of Directive 71/349/EEC on or before 30 June 2011. |

EXPLANATORY NOTE |

These Regulations are made to give effect, in so far as necessary, to Directive 2011/17/EU of the European Parliament and of the Council of 9 March 2011 repealing Council Directives 71/317/EEC, 71/347/EEC, 71/349/EEC, 74/148/EEC, 75/33/EEC, 76/765/EEC, 76/766/EEC and 86/217/EEC regarding metrology. |
||
The changes allow for revocation of the measures that were adopted to give effect to Directive 71/349/EEC which provided for an optional harmonised European system of calibration and EC verification of tanks of inland waterways and coastal vessels. |
||
Regulations 3 and 4 provide that the revocation will not affect the legality of any EC verifications carried out or calibration certification issued prior to 30 June 2011. |
