I, Etain Doyle, Director of Telecommunications Regulation, in exercise of the powers conferred on me by section 6(1) of the Wireless Telegraphy Act, 1926 (No. 45 of 1926) , and, section 4 of the Telecommunications (Miscellaneous Provisions) Act, 1996 ( No. 34 of 1996 ), and with the consent of the Minister for Communications, Marine and Natural Resources, pursuant to subsection (8) of the said section 4 and the Communications, Energy and Geological Survey of Ireland (Transfer of Departmental Administration and Ministerial Functions) Order 2002 ( No. 300 of 2002 ) and the Marine and Natural Resources (Alteration of Name of Department and Title of Minister) Order 2002 (No. 307 of 2002), hereby make the following Regulations: |

Citation |
1. These Regulations may be cited as the Wireless Telegraphy (Fixed Wireless Point To Multi-Pont Access Licence) (Amendment) Regulations, 2002. |

Interpretation |
2. (1) In these Regulations -- |
|||||
“the Principal Regulations” means the Wireless Telegraphy (Fixed Wireless Point To Multi-Point Access Licence) Regulations, 1999 ( S.I. No. 287 of 1999 ). |

(2) The Interpretation Acts, 1937 to 1997 apply to these Regulations. |
||||||
Amendment of the Principal Regulations |
3. Regulation 10 of the Principal Regulations is hereby amended by -- |
|||||
(a) the deletion in paragraph (1)(a) of the reference to the 24.5-26.5 GHz frequency band. |
||||||
(b) the insertion after paragraph (1)(b) of the following paragraph (1)(c) - |
||||||
“(c) Where the licence concerned relates to Apparatus used in the frequency band 24.5-26.5GHz, a fee of €500 per MHz is payable on issue of the licence and on each subsequent renewal thereafter.” |

Commencement |
4. The fees set out in paragraph (1)(c) (inserted by these Regulations) of the Principal Regulations apply to all licences of the type referred to in that paragraph issued or renewed after the entry into force of these Regulations. |

The Minister for Communications and Natural Resources hereby consents to the foregoing Regulations. |

These Regulations amend the Wireless Telegraphy (Fixed Wireless Point to Multi-Point Access Licence) Regulations, 1999 ( S.I. No. 287 of 1999 ) under which licences are issued to keep and have possession of apparatus for wireless telegraphy for the purpose of using FWPMA for the provision of telecommunications access networks and services. The Regulations provide for an amendment of the fee structure for apparatus in the 24.5-26.5GHz frequency band. |
