The Irish Horseracing Authority in exercise of the powers conferred upon it by subsection (21)(b) of Section 48 of the Irish Horseracing Industry Act, 1994 hereby makes the following Regulations:-- |

Citation and Commencement. |
1. (a) These Regulations may be cited as the Racecourses (Course-Betting Representative Permits) Regulations, 1999; |

(b) These Regulations shall take effect from the 1st day of July, 1999. |
||||||||||||
Definitions. |
2. (a) “the Act” means the Irish Horseracing Industry Act, 1994 ; |
|||||||||||
(b) “Registered Premises” shall have the meaning ascribed to it by Section 1 of the Betting Act, 1931 ; |
||||||||||||
(c) Section 2 of the Act shall also apply to the interpretation of these Regulations; |
||||||||||||
(d) Nothing in these Regulations shall prejudice the powers and entitlement of the Authority under the Act. |
||||||||||||
Amendment to definition of “employee or agent” in Section 48(21)(a) of the Act. |
3. The definition of “employee or agent” in Section 48(21)(a)(ii) of the Act is hereby amended by deleting the text contained in Section 48(21)(a)(ii) and inserting in its place the following: |

“(a) in the case of an authorised bookmaker operating from a Betting Office, a person who has been in the employment of a licensed bookmaker in a Registered Premises and/or a Betting Office for a period of not less than five years expiring on the date of the application for a course-betting representative permit in respect of such person; and |
||||||||||||
(b) in the case of all other authorised bookmakers, a person who has been in the employment of an authorised bookmaker (other than an authorised bookmaker operating from a Betting Office) on any authorised racecourse for a period of not less than five years expiring on the date of the application for a course-betting representative permit in respect of such person.” |
