CRIMINAL JUSTICE ACT, 1951 (SECTION 23) (DELEGATION OF POWERS) ORDER, 1998 |

The Government in exercise of the powers conferred on them by section 23A (inserted by section 17 of the Criminal Justice (Miscellaneous Provisions) Act, 1997 (No. 4 of 1997)) of the Criminal Justice Act, 1951 (No. 2 of 1951), hereby order as follows: |

1. (1) This Order may be cited as the Criminal Justice Act, 1951 (Section 23) (Delegation of Powers) Order, 1998. |
||
(2) This Order shall come into operation on the 20th day of October, 1998. |
||
2. The powers conferred on the Government by section 23 of the Criminal Justice Act, 1951 (No. 2 of 1951), are hereby delegated to the Minister for Justice, Equality and Law Reform. |

EXPLANATORY NOTE |
||
This Order delegates the powers of the Government, except in capital cases, to commute or remit, in whole or in part, any punishment imposed by a Court exercising criminal jurisdiction and to remit, in whole or in part, any forfeiture or disqualification imposed by such a Court and restore or revive, in whole or in part, the subject of the forfeiture. |
