MERCHANT SHIPPING (RO-RO PASSENGER SHIP SURVIVABILITY) (AMENDMENT) RULES, 1995. |

I, HUGH COVENEY, Minister for the Marine, in exercise of the powers conferred on me by section 10 (1) (as amended by section 29 of the Merchant Shipping Act, 1992 (No. 2 of 1992) and applied by section 743 of the Merchant Shipping Act, 1894), of the Merchant Shipping (Safety Convention) Act, 1952 (No. 29 of 1952), hereby make the following Rules: |

1. These Rules may be cited as the Merchant Shipping (Ro-Ro Passenger Ship Survivability) (Amendment) Rules, 1995. |
||
2. The Merchant Shipping (Ro-Ro Passenger Ship Survivability) Rules, 1994 ( S.I. No. 251 of 1994 ), are hereby amended by the substitution for paragraph (2) of Rule 7 of the following paragraphs: |
||
"(2) For the purpose of these Rules, any requirement to comply with a damage stability standard shall be satisfied by compliance with-- |
||
( a ) a relevant standard or code of practice of a national standards body or equivalent of any Member State or signatory State, or |
||
( b ) any relevant international standard recognised for use in any Member State or signatory State, or |
||
( c ) a relevant specification acknowledged for use as a standard by public authority of any Member State or signatory State, |
||
Provided that the relevant standard, code of practice or specification provides, in use, equipment levels of safety, suitability and fitness for purpose. |
||
(3) In this Rule "signatory State" means a signatory State to the Agreement on the European Economic Area done at Oporto on the 2nd day of May, 1992.". |

EXPLANATORY NOTE. |
||
The purpose of this amendment is to extend the provisions of Section 7 of the Merchant Shipping (Ro-Ro Ferry Survivability) Rules, 1994 to Signatory States of the Agreement on the European Economic Area. |
