I, DAVID ANDREWS, Minister for the Marine, in exercise of the powers conferred on me by section 91 of the Mercantile Marine Act, 1955 (No. 29 of 1955), and the Communications (Transfer of Departmental Administration and Ministerial Functions) Order, 1987 (No. 91 of 1987, hereby make the following Regulations:-- |

1. These Regulations may be cited as the Merchant Shipping (Tonnage Regulations, 1984) (Amendment) Regulations, 1994, and shall come into operation on the 1st day of April, 1994. |
||
2. The Merchant Shipping (Tonnage) Regulations, 1984 ( S.I. No. 369 of 1984 ), are hereby amended by-- |
||
( a ) the substitution for paragraph (2) of Regulation 12 of the following paragraph: |
||
"(2) This Part shall not apply to Irish fishing boats of less than 24 metres in length registered under Part IV of the Principal Act only, the tonnages of which shall continue to be as ascertained in accordance with the provisions of the Merchant Shipping (Registry, Lettering and Numbering of Fishing Boats) Regulations, 1989 ( S.I. No. 344 of 1989 )."; and |

( b ) the insertion of the following paragraph after paragraph (3) of Regulation 12: |
||
"(4) A ship, pleasure yacht or fishing boat to which this Part applies may in lieu of having its tonnage ascertained in accordance with this Part, have its tonnage ascertained in accordance with Part II of these Regulations.". |

EXPLANATORY NOTE. |
||
These Regulations amend the Merchant Shipping (Tonnage) Regulations, 1984 to allow vessels under 24m in length have their tonnage measured in accordance with Part II of the 1984 Regulations if their owners so request. |
