I, JUSTIN KEATING, Minister for Industry and Commerce, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), hereby make the following regulations: |

Short title | ||
1. These Regulations may be cited as the European Communities (Low Voltage Electrical Equipment) (No. 2) Regulations, 1976. |
||
Commencement | ||
2. These Regulations shall come into operation on the 1st day of March, 1976. |
||
3 Costruction |
||
3. These Regulations shall be construed as one with the European Communities (Low Voltage Electrical Equipment) Regulations, 1975 ( S.I. No. 62 of 1975 ). |
||
Penalty for importation and sale of electrical equipment | ||
4. Any person who imports, sells or leases, or offers for sale or for lease, electrical equipment in contravention of Regulation 4 of the European Communities (Low Voltage Electrical Equipment) Regulations, 1975, shall be guilty of an offence and shall be liable on summary conviction to imprisonment for a period not exceeding six months or to a fine not exceeding one hundred pounds or to both such fine and such imprisonment. |

Prosecution of Offences under these Regulations | ||
5. A prosecution for an offence under these Regulations may be brought by the Minister for Industry and Commerce. |

EXPLANATORY NOTE. |
||
These regulations are supplementary to the European Communities (Low Voltage Electrical Equipment) Regulations 1975 ( S.I. No. 62 of 1975 ) already made, giving effect to the European Communities Council Directive (73/23 EEC) of 19th February, 1973 on the harmonization of the laws of Member States relating to electrical equipment designed for use within certain voltage limits (O.J. No. L 77/29--26.3.1973). They provide for sanctions for breaches of the 1975 regulations. |
