I, BRIAN LENIHAN, Minister for Transport and Power, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), and the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and after due compliance with section 106 of that Act, hereby order as follows:

1. (1) This Order may be cited as the Harbour Rates (Waterford Port and Harbour) Order, 1972.
|
|
|
(2) This Order shall come into operation on the 23rd day of June, 1972.
|
|
|
2. The Waterford Harbour Act, 1919, shall be construed and have effect as if, for the matter contained in the Schedule to that Act (inserted by the Order of 1968), there were substituted the matter contained in the First Schedule to this Order.
|
|
|
3. The Harbour Rates (Waterford Harbour) Order, 1954 ( S.I. No. 225 of 1954 ), shall have effect as if, for the matter contained in the Schedule to that Order (inserted by the Order of 1968), there were substituted the matter contained in the Second Schedule to this Order.
|
|
|
4. The Harbour Rates (Waterford Cranage Rates) Order, 1964 ( S.I. No. 172 of 1964 ), shall be construed and have effect as if, for the matter contained in the Schedule to that Order, there were substituted the matter contained in the Third Schedule to this Order.

On every ton of the net register tonnage or of half the gross tonnage, whichever is the greater, of every vessel (other than a vessel bound from one port or place to any other port or place in the State, Northern Ireland or Great Britain) entering the harbour for the purpose of seeking shelter therein or for repairs or for orders and not discharging or loading cargo or passengers

On every ton of the net register tonnage or of half the gross tonnage, whichever is the greater, of every fishing vessel of seventy tons net register tonnage or over which is, for the time being, employed in sea fishing or the sea fishing service, for each time such vessel enters the harbour and does not load fish but makes use of the quays and wharves

Laying Up Charges.

On every ton of the net register tonnage or half the gross tonnage, whichever is the greater, of a vessel (other than a fishing vessel) for each week or part of a week during which the vessel is laid up after the expiration of twenty-one days from the first day on which the vessel is laid up a sum not exceeding
