AIR NAVIGATION (DEFINITION OF AIRCRAFT) ORDER, 1968

AIR NAVIGATION (DEFINITION OF AIRCRAFT) ORDER, 1968

I, ERSKINE H. CHILDERS, Minister for Transport and Power, in exercise of the powers conferred on me by Section 5 of the Air Navigation and Transport Act, 1946 (No. 23 of 1946), and the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), hereby order as follows:--

1. This Order may be cited as the Air Navigation (Definition of Aircraft) Order, 1968.

2. This Order shall come into operation on the 22nd day of August, 1968.

3. Article 3 of the Air Navigation (Nationality and Registration of Aircraft) Order, 1963 ( S.I. No. 88 of 1963 ), Article 2 (1) of the Air Navigation (Operations) Order, 1964 ( S.I. No. 140 of 1964 ), Article 2 (1) of the Air Navigation (Airworthiness of Aircraft) Order. 1964 ( S.I. No. 141 of 1964 ), and Article 2 (1) of the Air Navigation (Personnel Licensing) Order, 1966 ( S.I. No. 165 of 1966 ), are hereby amended by the substitution of the following definition for the definition of aircraft:

"'aircraft' means any machine that can derive support in the atmosphere from the reactions of the air other than the reactions of the air against the earth's surface.",

EXPLANATORY NOTE

The purpose of this Order is to give effect to a new definition of aircraft adopted by the International Civil Aviation Organisation which excludes ground reaction vehicles from coverage by the term.
