I, ERSKINE H. CHILDERS, Minister for Transport and Power, in exercise of the powers conferred on me by section 5 of the Air Navigation and Transport Act, 1946 (No. 23 of 1946) and the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), hereby order as follows :

1. This Order may be cited as the Air Navigation (Rules of the Air) (Amendment) Order, 1966.
|
|
|
2. In this Order " the Principal Order " means the Air Navigation (Rules of the Air) Order, 1963 ( S.I. No. 7 of 1963 ).
|
|
|
3. This Order shall come into operation on the 12th day of January, 1967.
|
|
|
4. The Principal Order and this Order may be cited together as the Air Navigation (Rules of the Air) Order, 1963 and 1966.
|
|
|
5. Each provision of the Schedule to the Principal Order mentioned in column (1) of the Schedule to this Order is hereby amended in the manner stated in column (2) of the Schedule to this Order opposite the mention of that provision in the said column (1).
|

Rule 1.
|
The insertion after the definition of "flight information service" of the following :
|
|
" 'flight levels' means the surfaces of constant atmospheric pressure which are related to a specific pressure datum of 1013.2 mb or 29.92 inches and are separated by specific pressure intervals."
|
Rule 2.
|
The substitution of the following Rule :
|
|
"2--(1) Compliance with the Rules of the Air. The operation of an aircraft either in flight or on the manoeuvring area of an aerdrome shall be in compliance with the Rules in this Part and, in addition, when in flight, either with--
|
|
(a) the Visual Flight Rules ; or
|
|
(b) the Instrument Flight Rules.
|
|
(2) In controlled airspace between sunset and sunrise or such other period between sunset and sunrise as may be specified by the appropriate authority an aircraft shall not be operated in compliance with the Visual Flight Rules without the specific permission of the appropriate authority.
|
|
(3) By night all aircraft within the State shall be flown in accordance with the Instrument Flight Rules or such modification of the Instrument Flight Rules as may be specified by the appropriate air traffic control unit.
|
|
(4) Unless authorised by the appropriate air traffic control unit or by the appropriate authority VFR flights shall not be operated above flight level 200.
|
|
(5) In Visual Meteorological Conditions the pilot in command shall fly in accordance with the Instrument Flight Rules if so required by the appropriate air traffic control unit or by the appropriate authority, or he may elect to fly in accordance with the Instrument Flight Rules.
|
|
(6) Responsibility for Compliance with the Rules of the Air. The pilot in command of an aircraft shall, whether manipulating the controls or not, be responsible for the operation of the aircraft in compliance with these Rules, except that he may depart from these Rules in circumstances that render such departure absolutely necessary in the interests of safety."

Rule 20.
|
The substitution of the following Rule :
|

"20--(1) When required by this Order to fly at a cruising level appropriate to track, the pilot in command of an aircraft shall, subject to the provisions of paragraph

(2) of this Rule, conduct the flight at a cruising level in accordance with the Table to this Rule, using the altimeter setting appropriate to the airspace in which the operation takes place.
|
|
(2) Exceptionally, on the basis of regional air navigation agreements, a modified table of cruising levels based on a nominal vertical separation of less than 600 metres (2,000 feet) but not less than 300 metres (1,000 feet) shall be used where prescribed by the appropriate authority for flights under specified conditions above flight level 290 within designated airspace.
|
|
(3) In the Table to this Rule, the word "track" means magnetic track or, in polar areas at latitudes higher than 70° and within such extensions to those areas as may be prescribed by the appropriate authority, grid tracks as determined by a network of lines parallel to the Greenwich meridian superimposed on a polar stereographic chart in which the direction towards the North Pole is employed as the Grid North.

Rule 26.
|
The substitution of the following for subrule (4) :
|
|
"(4) VFR flights operated in level cruising flight at 3,000 feet or 900 metres or more from the ground or water shall be conducted at a cruising level appropriate to track in accordance with the Table of Cruising Levels to Rule 20 except when otherwise required by the appropriate air traffic control unit or by the appropriate authority for VFR flights within controlled airspace."

EXPLANATORY NOTE.
|
|
|
This Order amends the Air Navigation (Rules of the Air) Order, 1963 ( S.I. No. 7 of 1963 ) by replacing on and from 12th January, 1967, by a new table of cruising levels the table of cruising levels set out in the Air Navigation (Rules of the Air) Order, 1963 ( S.I. No. 7 of 1963 ), and by making other necessary amendments consequential thereto.
