DAIRY PRODUCE ACT, 1924 (REGULATIONS UNDER PART III) (AMENDMENT) ORDER, 1955. |

I, JAMES M. DILLON, Minister for Agriculture, in exercise of the powers conferred on me by section 27 and section 29 of the Dairy Produce Act, 1924 (No. 58 of 1924), and of every and any other power me in this behalf enabling, hereby order as follows: |
||
1.--(1) This Order may be cited as the Dairy Produce Act, 1924 (Regulations under Part III) (Amendment) Order, 1955. |
||
(2) The Dairy Produce Act, 1924 (Regulations under Part III) Orders, 1925 to 1950, and this Order may be cited together as the Dairy Produce Act, 1924 (Regulations under Part III) Orders, 1925 to 1955. |
||
2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order. |
||
3. In this Order "the Principal Order" means the Dairy Produce Act, 1924 (Regulations under Part III) Order No. 1, 1925 ( S. R. & O. No. 51 of 1925 ). |
||
4. Paragraph (1) of Regulation 4 of the Principal Order is hereby amended by-- |
||
(i) the insertion in subparagraph (a) after "kegs to contain 56 lb.," of "fibreboard containers to contain 56 lb.," |
||
(ii) the insertion in subparagraph (b) after "wood" of "or fibreboard" and |
||
(iii) the substitution for subparagraph (d) (inserted by the Dairy Produce Act, 1924 (Regulations under Part III) (Amendment) (No. 2) Order, 1939 ( S. R. & O. No. 400 of 1939 )) of the following subparagraph: |
||
"(d) Fibreboard containers which have previously been used for any purpose shall not be used for the packing of butter but any other standard package in which butter has been delivered on sale may be used again for the packing of butter, if such package is clean and sound and has, prior to being so used again, been thoroughly steamed." |
||
5.--(1) Subparagraph (c) (inserted by the Dairy Produce Act, 1924 (Regulations under Part III) (Amendment) Order, 1939 ( S. R. & O. No. 129 of 1939 )) of paragraph (1) of Regulation 5 of the Principal Order is hereby amended-- |
||
(a) by the substitution in clause (i) of "Irish Creamery Butter, Produce of the Republic of Ireland" for "Éire Irish Creamery Butter," |
||
(b) by the substitution in clause (ii) of "Irish Butter, Produce of the Republic of Ireland" for "Éire Irish Butter", |
||
(c) by the substitution in clause (iii) of "Irish Butter, Produce of the Republic of Ireland" for "Éire Irish Butter," and |
||
(d) by the substitution in clause (iv) of "Irish Farm Butter, Produce of the Republic of Ireland" for "Éire Irish Farm Butter." |
||
(2) Paragraph (5) of Regulation 5 of the Principal Order is hereby amended by the substitution for subparagraph (a) (inserted by the Dairy Produce Act, 1924 (Regulations under Part III) (Amendment) Order, 1939) of the following subparagraph:-- |
||
"(a) The marks prescribed for packages shall, unless otherwise provided, be made in capital block letters and figures of the following dimensions, that is to say:-- |
||
(i) in the case of the words "Produce of the Republic of Ireland"--one-half inch high; |
||
(ii) in the case of all other prescribed marks-- |
||
(I) on 56 lb. and 28 lb. boxes--three-quarters of an inch high; |
||
(II) on 14 lb. boxesd--one-half inch high; |
||
(III) on casks, kegs and firkins--one-half inch high; |
||
(IV) on boxes used for packing rolls--not less than three-quarters of an inch high; |
||
(V) on fibreboard containers--three-quarters of an inch high; |
||
and shall be plainly inscribed thereon in the case of fibreboard containers by printing in durable green ink, and in the case of all other packages by printing or burning in a dark-brown colour, save that in the case of packages containing butter described as 'Irish Farm Butter, Produce of the Republic of Ireland,' the marks may be inscribed by stencilling." |

6. The First Schedule to the Principal Order is hereby amended by the insertion after the part headed "V. Specification, for Standard 14 lb. Pyramid Butter Box." of the part set out in Part I of the Schedule to this Order. |
||
7. The Schedule set out in Part II of the Schedule to this Order is hereby substituted for the Third Schedule to the Principal Order. |

SCHEDULE: |
||
PART I. |
||
VI. Specification for Standard 56 lb. Fibreboard Container. |
||
Number of Pieces: The container shall be one piece of the specified material. |
||
Material: Solid fibreboard of pure kraft or board with kraft facings, free from taint or other qualities likely to flavour butter and the surfaces amenable to the application of gummed tape and glue used in sealing operations. |
||
Thickness of Material: 0·100 inch with a tolerance of five per cent. (5%) above or below. |
||
Weight of Board: 2·7 lb. per 1,000 sq. inches. |
||
Bursting Strength: Dry: not less than 500 lb. per sq. inch. |
||
Wet: (i.e. after one hour's complete immersion in water): not less than 350 lb. per sq. inch. |
||
Colour of Material: Buff, or other shade prescribed by the Minister. |
||
Creasing of Material: The container shall be constructed free from rough or bulky creases and in the pressing out of the material all internal angles shall be formed with 3/8" fillets. |
||
Stitching: To be of stainless steel with eight stitches of ½" crown and gauge 12 x 25. The stitches should be evenly spaced and sealed on the inside with adhesive paper tape. |
||
Internal Dimensions: Length 15½ inches |
||
Width 10 inches. |
||
Depth 10¾ inches. |
||
PART II. |
||
I. Design to indicate the manner in which the prescribed marks should be placed on standard packages and on packages containing butter packed in rolls packed on premises registered in the register of creameries or comprised in a subsisting licence granted under section 42 of the act. |
||

II. Design to indicate the manner in which the prescribed marks should be placed on standard packages and on packages containing butter packed in rolls packed on premises registered in the register of manufacturing exporters and not comprised in a subsisting licence granted under section 42 of the act. |
||

III. Design to indicate the manner in which the prescribed marks should be placed on packages packed on premises registered in the register of butter factories |
||
. |
||
IV. Design to indicate the manner in which the prescribed marks should be placed on packages containing butter to which clause (iv) of paragraph (c) of sub-section (1) of Regulation 5 of this order applies. |
||
