CONTROL OF EXPORTS ORDER, 1953. |

I, SEAN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946) ), hereby order as follows : |
||
1.--(1) This Order may be cited as the Control of Exports Order, 1953. |
||
(2) This Order shall come into operation on the 1st day of July, 1953. |
||
2. In this Order-- |
||
" controlled articles " means articles specified in Part I of the First Schedule to this Order, not being articles specified in Part II of that Schedule ; |
||
" export " includes the exportation of articles brought into the State for transhipment, whether under bond or otherwise ; |
||
" appropriate officer " means, in the case of articles being exported by parcel post, an officer of the Minister for Posts and Telegraphs and, in any other case, the proper officer of Customs and Excise. |
||
3. A person shall not export any controlled articles unless-- |
||
(a) the articles are exported under and in accordance with a licence under this Order, and |
||
(b) the licence is delivered to the appropriate officer before the exportation. |
||
4.--(1) A Minister may, whenever and so often as he thinks fit, issue a licence to export any controlled articles of a particular description with or without limitation as to quantity, number or value. |
||
(2) Whenever a Minister issues a licence under this Order, he may attach to the licence any one or more of the following conditions : |
||
(a) a condition that the controlled articles to which the licence relates shall be exported within a specified time or during a specified period, |
||
(b) a condition that such articles shall be exported at a specified port or place or by a specified route, |
||
(c) a condition that such articles shall not be exported in more than a specified number of consignments, |
||
(d) a condition that such articles shall be exported by a specified person, |
||
(e) a condition that such articles shall be consigned to a specified consignee, |
||
(f) such other conditions as such Minister thinks fit. |
||
(3) Licences under the Emergency Powers (Control of Export) Order, 1940 (S. R. & O. No. 149 of 1940), and permits under the Emergency Powers (Export of Whiskey) Order, 1941 (S. R. & O. No. 26 of 1942), which were in force immediately before the commencement of this Order shall continue in force as if they were licences under this Order. |
||
5. This Order does not apply to the exportation of controlled articles as respects which the appropriate officer is satisfied that such articles-- |
||
(a) are being exported for repair and return, |
||
(b) are travellers' samples being exported after being imported temporarily, |
||
(c) are travellers' samples being exported temporarily to be subsequently re-imported, |
||
(d) are being re-exported to the country from which they were imported as a result of being refused by the consignees, or |
||
(e) are used containers of any material or description which are being re-exported empty to the sender. |
||
6. Nothing in this Order shall be construed as affecting in any way the operation of any Act (whether passed before or after the commencement of this Order), or any instrument made (whether before or after the commencement of this Order) by virtue of such Act, which authorises and provides for the control, regulation, restriction or prohibition of the export of any articles. |
||
7. The Orders specified in the Second Schedule to this Order are hereby revoked. |
