| | HARBOUR RATES (LIMERICK HARBOUR) ORDER, 1942, MADE BY THE MINISTER FOR INDUSTRY AND COMMERCE ON THE 15th DAY OF OCTOBER, 1942, PURSUANT TO SUB-SECTION (1) OF
SECTION 3
of THE
HARBOURS (REGULATION OF RATES) ACT, 1934
.

| | WHEREAS it is enacted by sub-section (1) of
section 3
of the
Harbours (Regulation of Rates) Act, 1934
(No. 2 of 1934), that the Minister for Industry and Commerce may, if and whenever he thinks fit on the application of the harbour authority for any harbour, by order (in the said Act referred to as a harbour rates order) fix all or any of the rates, or, where he so thinks fit, the maximum rates to be charged by the harbour authority of such harbour, and may for that purpose revoke, modify, alter or extend by such order any statutory or other provision fixing, restricting, or otherwise regulating the rates or the maximum or minimum rates chargeable by such harbour authority :

| | AND WHEREAS the Limerick Harbour Commissioners have applied pursuant to section 4 of the said Act to the Minister for Industry and Commerce for a harbour rates order in respect of the Port and Harbour of Limerick increasing the graving dock rates, fixing new maximum import and export rates in respect of goods and new maximum rates in respect of vessels entering or using the Port and Harbour :

| | AND WHEREAS the Minister for Industry and Commerce has pursuant to the provisions of sub-section (1) of section 5 of the said Act given notice dated the 17th day of September, 1942, of his proposal to make such order to the said Commissioners, and has given the directions mentioned in that sub-section in respect of the notice required thereby to be published by the said Commissioners :

| | AND WHEREAS the said Commissioners have duly published such notice, and such notice has contained the directions mentioned in sub-section (2) of section 5 of the said Act as regards making objections and representations to the Minister for Industry and Commerce in respect of such proposed order :
|
| | NOW, THEREFORE, I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by subsection (1) of
section 3
of the
Harbours (Regulation of Rates) Act, 1934
(No. 2 of 1934), and of every and any other power me in this behalf enabling, do hereby order as follows, that is to say :—

| |
Short title and commencement. |
| | 1.—(1) This Order may be cited as the Harbour Rates (Limerick Harbour) Order, 1942.
|
| | (2) This Order shall come into operation on the 20th day of October, 1942.
|

Application of
Interpretation Act, 1937
. |
| | 2. The
Interpretation Act 1937
(No. 38 of 1937) applies to this Order.
|
| |
Interpretation. |
| | 3.—(1) In this Order—
|
| | the expression " the Order of 1921 " means the Limerick Harbour Order, 1921 ;
|
| | the expression " the Commissioners " means the Limerick Harbour Commissioners ;
|
| | the expression " the port " means the existing Port and Harbour of Limerick ;
|
| | the expression " the harbour master " includes any harbour master and deputy or assistant harbour master for the time being appointed by the Commissioners ;
|
| | the expression " the collector of rates " means the collector of tonnage and goods rates for the time being appointed as such by the Commissioners ;
|
| | the word " vessel " means a ship, boat or other vessel of any description ;
|
| | the expression " the owner ", when used in relation to any vessel, shall extend to and include the owner or charterer of the vessel or his agent or consignee ;
|
| | the expression " the master ", when used in relation to any vessel, means the person having the command or charge of the vessel for the time being ;
|
| | the expression " Great Britain " includes the Channel Islands and the Isle of Man.
|
| | (2) This Order shall be construed as one with the Limerick Harbour Acts and Orders, 1823 to 1939, and the said Acts and Orders and this Order may be cited together as the Limerick Harbour Acts and Orders, 1823 to 1942.
|
| |
Increase of graving dock rates. |
| | 4. The graving dock rates referred to in section 20 of the Limerick Harbour Act, 1867 and specified in Schedule (B) to that Act are hereby increased to an amount equal to one hundred per centum of the respective amounts specified in the said Schedule and the Commissioners may demand, receive and recover such sums by way of graving dock rates as they may from time to time think fit not exceeding the graving dock rates authorised by the said Act as increased by this Order.

New Import and export dues on goods |
| | 5.—(1) The Commissioners may levy, demand and take in respect of all goods shipped, transhipped or unshipped within the port,
|
| | (a) in the case of goods specified in the First Schedule to this Order, sums not exceeding the several rates specified in the said Schedule,
|
| | (b) in the case of goods not so specified, a rate equal to the rate for the time being payable in respect of goods which are, in the opinion of the Commissioners, of a similar nature, package or quality.
|
| | (2) Every rate payable under this Article in respect of any goods shall be payable by the owner or consignee of such goods to the Commissioners or to such person as they shall appoint to collect and receive such rates.
|
| | (3) Where rates payable under this Article are fixed at a tonnage charge, lesser weights shall be chargeable as follows :—
|
| | (a) any weight under 5 cwt. shall count as 5 cwt.,
|
| | (b) any weight from 5 cwt. to 10 cwt. shall count as 10 cwt.,
|
| | (c) any weight over 10 cwt. to 15 cwt. shall count as 15 cwt.,
|
| | (d) any weight over 15 cwt. to 20 cwt. shall count as a ton.
|
| | (4) In this Order the expression " the new import and export dues " means the rates authorised by this Article.
|
| |
New tonnage rates. |
| | 6.—(1) The Commissioners may demand and take, in respect of all vessels entering or using the port, any rates (in this Order referred to as the new tonnage rates) not exceeding those specified in Part I of the Second Schedule to this Order.
|
| | (2) The provisions set out in Part II of the Second Schedule to this Order shall apply in respect of the new tonnage rates.
|
| | (3) The new tonnage rates in respect of a vessel shall be paid by the owner or master of the vessel.
|
| | (4) The harbour master is authorised and required to refuse to allow any vessel to leave the port until he receives from the collector of rates a permit showing that all the new tonnage rates due in respect of such vessel have been paid.
|
| |
Increase of harbour light dates. |
| | 7. Sub-section (1) of section 8 of the Limerick Harbour Order, 1903, shall have effect as if the rate therein mentioned in respect of vessels (other than steam tugs and home trade vessels) were a rate not exceeding twopence per ton of their rateable or register tonnage and the rate therein mentioned in respect of home trade vessels were a rate not exceeding one half-penny per ton of their net register tonnage.

| | Provided that the Commissioners shall so adjust the dues authorised by section 8 of the Limerick Harbour Order, 1903, as amended by this section, that the revenue derived therefrom shall not be more than sufficient to cover the expenditure incurred by the Commissioners in connection with the lighthouses, buoys and beacons referred to in the said section 8.

Adaptation of section 9 of the Order of 1921. |
| | 8. The reference in section 9 of the Order of 1921 to the rates and dues leviable under section 6 of the Order of 1921 shall be construed as a reference to the new import and export dues and the new tonnage rates.
|
| |
Application of existing statutory provisions to new rates. |
| | 9. The several statutory provisions and powers in respect of rates, charges, tolls, dues, rents and other money and receipts which may be taken or recovered by way of income by the Commissioners shall respectively extend and apply to the new import and export dues and the new tonnage rates.
|
| |
Application of moneys received from new dues and rates. |
| | 10. All moneys received by the Commissioners from the new import and export dues and the new tonnage rates shall be applied by them in the same manner and to the same purposes as the harbour dues specified in the Schedule to the Order of 1921 were applicable.
|
| |
Saving. |
| | 11. Nothing in this Order contained shall prejudice or affect the powers of the Commissioners to levy, collect or recover any rates, dues or sums of money leviable by or due to the Commissioners at the commencement of this Order, and such rates, dues and sums of money may be levied, collected and recovered by the Commissioners in the same manner and subject to the same conditions as if this Order had not been made and come into operation.

| | 12. Section 5, sub-sections (2) and (3) of section 6, and section 7 of the Order of 1921 and the whole of the Harbour Rates (Limerick Harbour Export Rate on Cement) Order, 1937 (

| | PART II.
|
| | PROVISIONS APPLICABLE TO RATES MENTIONED IN PART I OF THIS SCHEDULE.
|
| | 1. Every vessel entering any dock in the port other than the graving dock more than once in a month and paying for same shall be free from dock rates on each alternate entry into such dock for the remainder of such month.
|
| | 2. The rates mentioned at reference numbers 1, 3, 5, 6, and 8 in Part I of this Schedule shall not be chargeable on vessels trading in or upon the River Shannon.
|
| | 3. For the purpose of calculating the harbour and dock rates mentioned at reference numbers 1, 2, 3, 4, 5, 6, 7, and 8 in Part I of this Schedule—
|
| | (a) the tonnage of vessels (other than mechanically propelled vessels) shall be taken to be the net register tonnage thereof.
|
| | (b) the tonnage of mechanically propelled vessels shall be taken to be the rateable tonnage thereof as defined by section 4 of the Limerick Harbour Order, 1903, and for this purpose the references in sections 4 5 and 7 of that Order, to steam vessels and steam tugs shall be construed as references to mechanically propelled vessels and mechanically propelled tugs respectively.

| | 4. For the purpose of calculating the harbour rates mentioned at reference numbers 10, 11, 12 and 13 in Part I of this Schedule, the tonnage of vessels shall be taken to be the net register tonnage thereof.
