Introduction
1. The
Competition Authority has decided to amend Article 7 of the cylinder LPG
category licence (Decision no. 364 of 28 October 1994). As a consequence
paragraph 61 of the decision is also amended. The purpose of the amendment is
to allow the reporting condition in Article 7 to be met by the end of June of
each year. Notice of intention was published in the Irish Times on 9 June 1995
and no submissions were received from interested parties.

2. Paragraph
61 of the decision and Article 7 of the category licence are amended as follows:
61. In
order to facilitate this early review of the category licence, the Authority
considers that it is necessary to attach certain reporting conditions to the
licence. The suppliers will be required to make an annual report to the
Authority, for each calendar year, in respect of dealers supplied and sales of
cylinder LPG to dealers, so that the Authority can monitor developments in the
market. Thus all suppliers who take advantage of the category licence will be
required, every year before the end of June, to send a report to the Authority
covering the preceding year. The reports shall contain the following information:
(a) the
total number of dealer LPG agreements in operation at the end of the preceding
year;
(b) the
total number of new dealer agreements made during the preceding year;
(c) the
total number of dealer agreements terminated during the preceding year; and
(d) the
total volume of sales, in tonnes, to dealers in standard domestic cylinders
(i.e. 11.343 kg) during the preceding year.

3. It
is a condition of this category licence that suppliers are required every year
before the end of June to send a report to the Competition Authority in respect
of the following:
(a) the
total number of dealer LPG agreements in operation at the end of the preceding
year;
(b) the
total number of new dealer agreements made during the preceding year;
(c) the
total number of dealer agreements terminated during the preceding year; and
(d) the
total volume of sales, in tonnes, to dealers in standard domestic cylinders
(i.e. 11.343 kg) during the preceding year.
4. For
the avoidance of doubt, failure by a supplier to comply with this condition
shall have the effect that the agreements of that supplier do not benefit from
this category licence.
