Applicant claimed to be cohabiting with the (now deceased) registered proprietor who had indicated an intention that after his death the property would be sold and she would have a one third share of the proceeds of sale - in final submissions Applicant’s solicitor acknowledged that even if what Applicant said was true (which it was held not to be) her claim must fail as the alleged intention was not sufficient to establish a common intention constructive trust of an immediate beneficial share in the property.
