MR JUSTICE HENDERSON:
"(3) ... a participating issuer may determine that persons entitled to receive notices [of the relevant types] are those persons entered on the relevant register of securities at the close of business on a day determined by him."

The company and its solicitors took the decision to proceed in the correct way, they gave instructions accordingly, those instructions were inadvertently not carried out, and in my judgment the error in giving effect to the correct instructions is, on the part of the company, properly to be characterised as an accidental omission."
