- MR JUSTICE KING: In this matter there is before me an application made by the appellant to withdraw his extradition appeal subject to the approval of the court. An order has been consented to both by the appellant and those acting on behalf of the respondent. I accede to the application. I make an order in the following terms which follows the draft order:
Upon the appellant not wishing to proceed further with the appeal and it being declared that neither the appellant nor the respondent is a child or patient it is ordered:
(1) the appeal be dismissed;
(2) the required period for the purposes of Section 36 (3) of the Extradition Act 2003 shall start with the date this order is pronounced in open court;
(3) there be no order for costs save for a detailed assessment of the legally aided party's public funding certificate.
