"Unfortunately the UK Border Agency wrongly believed that the claimant's date for release was 9 July and therefore incorrectly placed him in detention under immigration powers. The claimant was therefore in dual detention in error from 9 July."
"A person is liable to removal if
(a) He is liable to deportation under section 3(5) of the Immigration Act 1971 (c.77) and has been notified of a decision to make a deportation order against him."
"A person who has served a period of imprisonment may be detained under the authority of the Secretary of State.
(a) While the Secretary of State considers whether section 32(5) applies, and
(b) Where the Secretary of State thinks that section 32(5) applies, pending the making of the deportation order."
