Goncalves v Her Majesty's Chief Inspector of Schools [2005] EWCST 525(EY-SUS) (15 August 2005)
D E C I S I O N
ROSA MARIA GONCALVES
v
HER MAJESTY'S CHIEF INSPECTOR OF SCHOOLS
[2005]
Hearing at 18 Pocock Street, London on 4 August 2005
Miss Goncalves (the Appellant) appeals under the Child Minding and Day Care (Suspension of Registration) (England) Regulations 2003 and Protection of Children and Vulnerable Adults and Care Standards Tribunal (Amendment) Regulations 2003, issued under Part XA of The Children Act 1989 against the decision of OFSTED (the Respondent) to suspend her registration as a childminder.
Ms E. Gray of Counsel, representing the Respondent, informed us at the beginning of the hearing that in view of the recently issued report from Social Services in relation to the enquiry under section 47 of the Children Act, various meetings were planned with the Appellant in the near future to decide on future actions.
Mr D. Casey of Counsel, representing the Appellant, said that in view of the above report his instructions were to withdraw the appeal.
We therefore determined to dismiss the appeal. Any application for costs should be lodged with the Care Standards Tribunal within 14 days from the receipt of this decision. If no applications are received, there will be no order for costs.
Order
That the appeal be dismissed.
Dated 15 August 2005
Rosemary, Lady Hughes Chairman
Ms L. Redford
