"Mr Hodges is convinced of the seriousness of his actions on the day of the offence and deeply regrets his failure to take appropriate action when approaching the road junction. While there is no doubt that a custodial sentence will serve as a punishment and offer the public some protection by removing him from the community, I do not believe it would punish him more than that of his own conscience".
