The facts
'(2) An order may also provide that unless the order is complied with the claim or, as the case may be, the response shall be struck out on the date of non-compliance without further consideration of the proceedings or the need to give notice under rule 19 or hold a pre-hearing review or hearing.'
'In these circumstances, it seems to me that the appeal is hopeless as against the Judgment of 25 October. There was no discretion at that point in the process; the Judge was bound to enter Judgment, because it is common ground that paragraph 2 of the unless order requiring the Claimant to file a witness statement was not complied with within the extended timescale. In these circumstances, I see no alternative but to dismiss this appeal.'
