- LADY JUSTICE ARDEN: This is Mr Martin-Samos' application for permission to appeal. The matter has been listed for today and Mr Martin-Samos was given notice of this date for this hearing. However, he has not appeared and the court has waited for 15 minutes to see whether he was perhaps delayed. Unfortunately he has not appeared.
- What I propose to do in those circumstances is to stand the matter out for a date to be fixed within the next 14 days and direct that he should be given notice of a further hearing. But on that occasion he should make every endeavour to be here. Alternatively, if there is some reason why he simply cannot be here he must communicate with the listing office in advance of the hearing to let the court know. It may very well be that court will simply have to proceed with his application if he is not here at the appointed time on the next occasion.
ORDER: Application adjourned. Transcript of this judgment to be sent to the applicant at public expense.
