- LADY JUSTICE HALE: The situation is this. The wife's solicitors undertake to set out a full account, supported by appropriate documentation, of the steps taken in implementation of the order made by District Judge Bullock on 2nd March 1998 and confirmed by His Honour Judge Taylor on 14th January 1999. They also undertake to provide the wife's account of what happened in relation to the contents of and possession of 43 Redshank Close between the date of the husband's imprisonment in April 1997 and possession being taken by the mortgagee in or about November 1997. On that basis the matter is adjourned.
- In the event that the court is satisfied in relation to those matters, the court may deal with these applications on paper. Mr Aydin will, of course, have permission to serve an affidavit in response to that information should he be so advised.
- I am sorry to have to deal with the matter in this way. I would have preferred to dispose of it straightaway, but of course I cannot dispose of it. Were I to give permission to appeal it would have to go before a full court, and at the moment it is difficult for me to see whether an appeal on any of this would have any prospect of success. But it is for those reasons that I am further adjourning for the further information of the court.
ORDER: Application for permission to appeal adjourned.
