- LORD JUSTICE THORPE: Lord Justice Kay will give the first judgment.
- LORD JUSTICE KAY: This is an application for permission to appeal. There has been no attendance today either by the applicant or by solicitors or counsel on her behalf. As a result the court has made enquiries and has had faxed to it a copy of a letter purporting have been sent on 16th August to the Civil Appeals Office written by the solicitors acting for the applicant in which they indicate that they are withdrawing the application and the matter is now discontinued. That letter apparently did not reach the Court of Appeal office and accordingly the matter has been listed. However, since it is not intended to pursue this matter any further, the application dismissed.
Order: Application dismissed.
