- LORD JUSTICE BUXTON: This is an application for permission to appeal against a decision of the Nottingham County Court. It has been the subject of several adjournments. It was put on specially today to accommodate the applicants. However, yesterday they wrote a long letter to the Court explaining that that they have a series of serious medical problems that precludes their attendance. I am not going to dismiss the application today for want of prosecution. What I intend to do is administratively to cause the applicants to be contacted and they are to be told -- and it is decision that I make now -- that it is a condition of this application not being dismissed today that they must submit to it being decided by me on paper and not further in Court.
