"... sought advice and debated this and the draft letters with the Claimant. They knew the Claimant's charge rate and that they were running up legal fees in approaching the matter in this way. They themselves made clear their dissatisfaction with the Claimants and thus once it was suggested that the Claimants withdraw, it would have been sensible of them to accept this advice rather than argue. They must expect to pay for what they actually got, which was the benefit of a view on the merits of their position and answers to the various challenges they raised."
