- LORD JUSTICE JUDGE:I understand that this case has been called outside and there is nobody here. I suspect that is because we have been told that the case has, in effect, been settled. We have a copy of a faxed consent order. The parties come from Manchester and places further North, and I suspect that they did not really give their minds to whether they needed to attend, having settled the case.
- We shall order that this case will be dealt with by consent in the following terms:
1.The judgment figure of £150,000 shall be substituted for the original judgment sum in the order of 21st March 2000.
2.The claimant shall give credit in the sum of £6,966.95 in respect of benefits received.
3.The defendant will pay the claimant's costs of the action, including the costs of the appeal, to be agreed, in default of which submitted for detailed assessment.
4.Community Legal Service assessment of the claimant's costs pursuant to regulation 107 of the Civil Legal Aid (General) Regulations 1989.
Order:by consent, as in 1 to 4 above.
