"If the Tribunal had heard the medical evidence which the jury heard they might have accepted that the overdosage of certain drugs had adversely affected Mr Kaberry's professional judgment and caused him to act in a way which he would not otherwise have done. But the Tribunal would not and in my view could not have taken the view on all the facts that Mr Kaberry at the material time was acting like a man in a dream or in a trance. The Tribunal might have thought his responsibility was reduced but could not properly have regarded it as extinguished. He was effectively accepting that the facts alleged against him were correct. On those facts, and in the light of authority over the last decade or so, the Tribunal could not properly have regarded Mr Kaberry as a proper person to remain on the Roll of Solicitors. If a solicitor can act in this way and escape the ultimate sanction, public confidence in the profession would be gravely undermined and that is a crucial matter for the Tribunal to bear in mind."
