Civitta Eesti AS, established in Tartu (Estonia), represented by C. Ginter, lawyer,
applicant,
v
European Commission, represented by L. André and S. Romoli, acting as Agents,
defendant,
APPLICATION under Article 263 TFEU for, first, annulment of the Commission’s decision of 12 October 2021 rejecting the applicant’s tender for Lot 5 of tendering procedure MOVE/2020/OP/0008 and, second, annulment of any consequent, intended or related measure taken by the Commission in the context of the procurement procedure for Lot 5 of tendering procedure MOVE/2020/OP/0008, and, in particular, annulment of the tender evaluation reports and any contract entered into with the successful tenderer.
1 By letter lodged at the Court Registry on 27 December 2021, the applicant informed the Court, in accordance with Article 125 of the Rules of Procedure of the General Court, that it wished to discontinue proceedings. It sought no order as to costs.
2 By letter lodged at the Court Registry on 20 January 2022, the defendant informed the Court that it did not oppose the applicant’s request to discontinue the proceedings and requested, in accordance with Article 136(1) of the Rules Procedure, that the applicant be ordered to bear the costs.
3 Article 136(1) of the Rules of Procedure provides that a party who discontinues or withdraws from proceedings is to be ordered to pay the costs if they have been applied for in the other party’s observations on the discontinuance.
4 The case shall therefore be removed from the register and the applicant ordered to pay the costs including those relating to proceedings of interim measures.
On those grounds,
THE PRESIDENT OF THE SIXTH CHAMBER OF THE GENERAL COURT
hereby orders:
1. Case T-665/21 is removed from the register of the General Court.
2. Civitta Eesti AS shall pay the costs including those relating to proceedings of interim measures.
