APPEAL lodged against the order of the Civil Service Tribunal (First Chamber) of 13 July 2010 in Case F-103/09 Allen and Others v Commission, dismissing as inadmissible the action seeking compensation for the material harm allegedly suffered by the applicants as a result of the fact that they were not recruited under contracts for temporary servants to exercise their activity at the Joint European Torus (JET) Joint Untertaking.
1 By letter lodged at the Registry of the General Court on 24 March 2011, the applicant, Mr R. Squibb, informed the Court in accordance with Article 99 of the Rules of Procedure that he wished to withdraw his application. He made no claims concerning the costs.
2 By letter lodged at the Registry of the Court on 11 April 2011, the defendant informed the Court that it had no objections on the withdrawal. It made no claims concerning the costs.
3 The first subparagraph of Article 87(5) of the Rules of Procedure provides that a party who discontinues or withdraws from proceedings shall be ordered to pay the costs if they have been applied for in the observations of the other party on the discontinuance. In the present case, the defendant did not make any claims concerning the costs.
4 The applicant, Mr R. Squibb, will therefore be removed from the register and each party shall be ordered to pay its own costs.
On those grounds,
THE PRESIDENT OF THE APPEAL CHAMBER OF THE GENERAL COURT
hereby orders:
1. In Case T-433/10 P, Mr R. Squibb is removed from the register of the General Court.
2. Each party shall be ordered to pay its own costs.
